Product Liability Basics



"Product" liability is the branch of tort law that holds designers, manufacturers, and sellers responsible for the harm suffered by buyers and users of defective products. A product can be anything, from an aeronautical chart to a plastic bag. Defects are flaws in the way a product is designed, manufactured, or marketed that may cause harm or death. Typical causes in defective product cases include warranty obligations, negligence, manufacturing and design problems and failure to warn about the problems.

I was heating up a pan of oil and the pan developed a hole in the bottom of the pan and it exploded

bite into my sandwich and had a hard time swallowing this bite i took. I starting gaging because it got stuck in the back of my thoart. It happened this morning. I called mcdonalds and the guy was like well i can replace it come by tomorrow yada yada yada. Now im afraid to even eat at another fast food place because this is not the first time i have had an issue with one. I found a piece of plastic in a frosty from wendys before. but any who, i could have choked on that plastic wrap im so glad that my body decided to gag and not let me eat it.

I had extensive damage to a tooth after biting into a bone fragment. The tooth could not be saved and was pulled. Another tooth started to hurt shortly after the tooth was pulled. The dentist did a crown and root canal on that one. He stated that the problem was caused by the missing tooth. I live in California -it happened in Colorado. Both companies are in Illinois. The food company and the insurance company verbally told me that my expenses would be paid. I sent the insurance company everything that was requested of me. The injury occurred on February 1, 2010. Around February 26, 2012 the insurance company told me that the claim had been denied because the Statute of Limitations had run out on February 1, 2012. I believe that they committed fraud against me. They failed to process my claim. I relied upon their verbal agreement that they would cover all of my expenses. I have paid the bill -just over $6000. Is there anything that I can do?
